By submitting material to any of our servers, for example by e-mail or via World Wide Web pages, you agree to the following terms. You make the material available knowing that we may publish it. You warrant that the material is fit for publication. You agree to indemnify us if any third party takes action against us in relation to the material you submit. You agree not to take action against us in relation to material that you submit. By submitting material you warrant that you believe 1AffordableCall may publish the material and/or incorporate it or any concepts described in it in our products without liability. The provision of information to 1AffordableCall means that you have provided explicit permission to process (lawful and fair processing) that information under the provisions of the Data Protection Acts 1998 and 2000. Any details which you provide to us from which we can identify you are held and processed in accordance with the Data Protection Acts.

Whilst we will endeavour to meet your requirements as quickly as possible by passing your details on to product providers (you are consenting to the use of the data in the manner described herein) you, or we, may terminate authority to act on your behalf at any time, without penalty (this does not include fees payable to other parties) any monies paid over for the and without prejudice to the completion of any transactions initiated prior to the receipt of such notice. If terminated by you, notice of this termination must be given in writing.

Information provided to clients

Savings versus BT:

In the price comparison tables, all prices are compared against the standard British Telecom (BT) tariff without any discounts or promotions. They are quoted to 2 decimal places and are inclusive of VAT. The BT minimum call charge is 5p per call. After this initial period all calls are charged per second at the prevailing rate. All savings are based on comparing the rates for all the Telephone Service Providers against the equivalent BT standard rate for each time band (i.e. Daytime vs Daytime, Evening vs Evening and Weekend vs Weekend). All rates are inclusive of VAT and the 'percentage savings' are rounded to the nearest whole number.

Telephone Calling Patterns - Savings Calculation:

All calculations are based on 'Call Time' (i.e. the amount of time to each type of destination and time band) as provided by the client.

All prices and percentage savings are compared to BT standard rates and/or against your alternative provider (where applicable).

In cases where you are subscribed to more than one telephone service provider it is assumed that all calls are made using the cheapest rate available to you.

When International destinations are not specified, a call rate based on the average call price to 30 popular international destinations is used.

If the Telephone Service Provider offers 'Inclusive calls' or FREE call entitlements, it is assumed that they are fully used, unless otherwise stated.

For both direct & indirect service providers the savings & percentage savings includes any differences in line rental and monthly fees (if applicable) as compared to the BT standard line rental, together with any call connection charges (levied by some providers). Any initial connection/set-up fees and/or equipment purchase costs are a one-off cost these are NOT included in the savings calculation, but are highlighted as additional costs.

PLEASE NOTE: For all indirect telephone services you will need to continue to pay the BT line rental - you cannot be a 'BT Light User'.

Processing Orders:

Credit card payments:

We have teamed up with ClickBank, a quality, highly secure, easy-to-use online credit card payment processor with a revered Internet reputation and presence. They use state of the art SSL (Secure Socket Layer) and encryption methods to ensure completely secure transactions. It is important to note that your credit card will show a charge by "CLICKBANK/KEYNETICS" and NOT 1AffordableCall.

All charges are based on US dollar amounts, but you will be billed in Sterling on your credit card statement. The exact exchange rate is determined by the credit card company shortly after the sale is made. Due to the slight variations in the exchange rate the precise amount that you pay may be slightly less or more than the quoted price. The rate will be reviewed & updated on a monthly basis using the value published in the 'Financial Times'. If, in the unlikely event, you are charged more than 10% more than the quoted price, you will be refunded IN FULL by cheque.

Cheque/Postal Order payments:

We have provided downloadable Word & Notepad forms to help you with these methods of payment.

Fulfilling Orders:

We will process your request in 3-5 working days, after payment by credit card or once your postal order is received or your cheque clears. If, in the unlikely event, we cannot dispatch the information to you within 5 days, we will contact you by e-mail and advise you of the new dispatch date.

Residential Client Guarantees:

All guarantees are effective for 90 days after the date of dispatch of the information by e-mail to you and are in addition to your statutory rights. As many telephone service providers reserve the right to change rates and charges without prior notification, we cannot be held responsible for any changes made during this 90 day guarantee period after we have dispatched the information to you.

On receiving the information, the client is responsible to check that all rates and charges provided in the are correct prior to signing up with any service. By signing up with the recommended provider(s) you are accepting that all guarantees/terms have been met.

Complaints:

If you have any concerns about the service that we have provided please contact us by e-mail. We welcome complaints and will:

1. Acknowledge receipt within 5 working days

2. Investigate complaints fully & fairly

3. Advise you how long the matter will take to resolve

4. Wherever possible we will find a remedy

5. Keep you informed throughout the entire process

6. Use such information to improve our services

If, in the unlikely event, we cannot resolve the issue to your complete satisfaction, we would recommend the use of an independent dispute resolution service, such as that provided by Which? Consumers Association.

Refunds:

We will correct any mistakes in bills, receipts or payments within 30 days of agreeing to do so. All refunds will be made by cheque to the address provided.

Monthly Prize Draw Rules

The monthly prize draw will be subject to the following conditions:

1. You are limited to ONE entry per person per month per provider. No repeat entries are allowed.

2. All questions on the form must be completed

3. The draw will take place on the last day of each calendar month & is subject to a minimum of 10 different entrants.

4. The WINNER will be notified by e-mail within 14 days of the draw & will be given a special keyword that they can submit together with the online application form.

5. The prize must be claimed within 3 months of the draw.

6. The prize is not exchangeable for cash.

7. If, in the opinion of 1AffordableCall, anyone has submitted incorrect or misleading data, the entry will be removed from the draw.

Jurisdiction

In addition, the information contained in the 1AffordableCall.co.uk Website is provided for UK citizens only and English Law governs the terms and conditions and you submit for our benefit to the non-exclusive jurisdiction of the English Courts. The Courts of England and Wales shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with this Website and its use and these Terms.

Where national regulatory authorities have jurisdiction over the contents of this Website, 1AffordableCall has attempted to ensure compliance with the requirements of such regulatory body. However, some of the information in the pages contained in this Website is not to be accessed from certain jurisdictions and no representation or warranty is made as to whether the information available in this Website complies with the regulatory regime of countries from which the pages in this Website should not be accessed.
